Last Will of Daniel McFarland |

Daniel McFarland was born in Scotland and fought in the Revolutionary War at the age of 14. He later fought in the War of 1812. This is a transcript of his will, which was written May 1st, 1814, in Beaver County, Pennsylvania. The spelling and punctuation are the same as they appeared in the original will.
Also included on this page are the orphan's court records in which guardians were appointed for three of Daniel's four children.
In the name of God amen. I Daniel McFarland of south Beaver Township Beaver County and State of Pennsylvania, farmer being verry sick and weak in and of Body but of sound mind memory and understanding blessed be god for the same but considering the uncertainty of this Transitory life to make publish and ordain this my last will and Testament in manner and form following that is to say first of all I commend my immortal Soul into the hands of God who gave it and my Body to the earth to be buried in a decent and christain like manner at the discretion of my executor herein after named and as to such worldly Estate as it hath pleased God to bless me in this life I give and dispose of the same in the following manner _ first of all it is my will and I do order that all my Just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease Secondly it is my Will and I do order that my family live to gether untill next fall and that the enjoy the full use and benefit of all my property until that time excepting one Cow and one Ewe which I gave and bequeath to my eldest daughter Polly she being the one that formerly was called here by the family and which she shall have full power to take and dispose at any time she may think proper after my decease. Thirdly it is my will and I do order that my Executor disposes of all my property next fall together with the Lease of the Land I now live on in such manner as the may think best excepting such things as I shall now specify (that is to say) the Bead and Bedding where on I now lie also the new Spinning Wheel and reel which I give and bequeath to my loving Wife, Susannah McFarland. Likewise the grain that is now in the ground together with the Spring Crop that they may raise this season the same I give and bequeath to my aforesaid Wife and such of the family as may continue to live with her for their use and is not to be sold by my Executors it is also my Will that when my Executors dispose of my prop erty and have paid all my Just debts that the same be divided into five equal shares and that two of said Shares be given to my before named wife and the other three shares to be given to my sons Petter and Daniel and my daughter Betsey to each one share it is also to be understood as my Will that my executors is not to take any account of the property untill next fall which time the are to Make the sale Except only such debts as may be due me which I wish them to collect and pay such debts as I owe so far as the shall extend and Lastly it is my Will and I do hereby nominate constitute and appoint my trusty friends Thomas Hamilton and James Kennedy to be my Executors and do hereby authorise and impower them to do and transact all busness relative of my Estate in like manner as I in my life time could do In Witness whereof I have hereunto subscribed my name and affixed my Seal this first day of May in the year of our Lord one thousand eight hundred and fourteen

Beaver County SealThis 13th day of May Anno Dominis 1814 before me Samuel Lawrence Register for the Probate of Wills and granting Letters of Administration in and for said County of Beaver personally came James Hamilton & Hugh Hamilton the Subscribing Witnesses to the above and foregoing Will and bein duly sworn according to law did depose and say that they were present and saw and heard Daniel McFarland the Testator make his mark to and publish pronounce and declare the foregoing instrument of writeing as and for his last Will and Testament and that at the Time of so doing he was of perfect and sound memory and understanding according to the best of their knowledge observation and belief, and that they signed their names thereto as Witnesses in the presence of the Testator
In Testimony whereof I have hereunto set my hand and affixed the seal of said office at Beaver the day & year above

Orphans Court, Beaver, Beaver Co, PA, January Term 1815, volume 1, page 49, number 5: On petition of Peter McFarland a minor son of Daniel McFarland, late of said county, dec'd, stating that his said father lately died leaving him, the petitioner, a minor above the age of fourteen and praying leave to choose a Guardian. Whereupon, the petitioner being admitted chooses Thomas Kennedy, who is appointed Guardian to the person and estate of said minor during his minority.
November Term 1815, volume 1, page 57, number 10: Came into court Peter McFarland a minor son of Daniel McFarland, late of said County of Beaver, dec'd, setting forth that his said father lately died, leaving the petitioner a minor above the age of fourteen years, and that your petitioner made application at March Term last to choose a Guardian, on which application Thomas Kennedy was chosen by your petitioner and approved by the Court. That your petitioner is now desirous of being bound an apprentice to the said Thomas Kennedy, and therefore prays the Court to admit him to make choice of some other person as a Guardian. Whereupon being admitted chooses David Davies (?) who is appointed Guardian of the person and estate of said minor during his minority.
Orphans Court, Beaver, Beaver Co, PA, January Term 1815, volume 1, page 48, number 3: 4th January 1815 On petition of Elizabeth McFarland a minor daughter of Daniel McFarland late of said County dec'd setting forth that her said father lately died leaving the petitioner a minor above the age of fourteen years and praying leave to make choice of a guardian. Whereupon, the petitioner being admitted chooses Thomas Kennedy, who is appointed by the Court guardian of the person and estate of said minor during her minority.
Orphans Court Records, Beaver, Beaver Co, PA, January Term 1815, pages 48-49, number 4: On petition of Susannah McFarland, widow and relict of Daniel McFarland late of said county, deceased, stating that her said husband lately died, leaving issue one child to wit Daniel McFarland, a minor under the age of fourteen years, and praying the Court to appoint a Guardian to take care of the person and estate of said minor. Whereupon the Court appoint Thomas Kennedy Guardian of the person and estate of said person during his minority.
